TERMS AND CONDITIONS FOR PUBLISHERS

Revenue Blue Publishers Term

PLEASE READ THESE TERMS AND CONDITIONS BEFORE REGISTERING FOR THE Revenue Blue PUBLISHER ONLINE PROGRAM.


General Guideline

Subject to our acceptance of you as an Affiliate and your continued compliance with the terms and conditions of this Agreement, to Revenue Blue (Molten Infotech LLP) agrees as follows:

1. General Legal Requirements

Every affiliate commits himself to take adequate measures to comply with all relevant laws and regulations, including relevant Codes of Conduct (Premium SMS services) and/or Carrier rules and copyright laws.

2. Inquiry

Every network is obligated to fully cooperate during an inquiry by the local regulatory body or any official institution by presenting to Revenue Blue (Molten Infotech LLP) the traffic source and other related matters for the investigation purposes within 2 business days. Under no circumstances, will the personal information of the traffic source be obtained. By failure to fulfill obligations publisher resigns from forfeiture of payments from Revenue Blue (Molten Infotech LLP) (including payments based on impressions, click through, sales or leads), and/or contractual or other legal liability, including but not limited to consequential damages, as applicable, as well as immediate termination / suspension from Revenue Blue (Molten Infotech LLP)’s network programs.

3. Targeting

Revenue Blue (Molten Infotech LLP) strictly prohibits publishers from advertising on cash back unless Revenue Blue (Molten Infotech LLP) has given its prior approval. Targeting at minors is strictly prohibited.

4. Wording

Do not use “Free” or any of its synonyms such as, but not limited to, “no charge”, “no cost”, “zero cost”, or “Gratis” in any language. Use of “100% complimentary” or any of its synonyms in any language is strictly prohibited.

5. Misguidance

All descriptions of Revenue Blue (Molten Infotech LLP) must be accurate. For example, a ringtone subscription service must be described as a ringtone subscription service and may not be described as a horoscope, subscription service, survey, an IQ Quiz...etc.

6. Insinuation

Do not insinuate that consumer has won a prize before joining the quiz and do not insinuate that Revenue Blue (Molten Infotech LLP)’s promotion is especially made for only one individual consumer.

7. Creative

The use of creative /texts (banners, jump pages/prelander, e-mail, text ads etc) that include brands/logos/trademarks which were not provided by Revenue Blue (Molten Infotech LLP) will only be allowed upon Revenue Blue (Molten Infotech LLP)’s approval. Any modification to Revenue Blue (Molten Infotech LLP)’s creative, including but not limited to banners, landing pages/jump pages are subject to Revenue Blue (Molten Infotech LLP)’s written approval.

8. Adware/Spyware

Do not use any adware, spyware, or any other kind of software on any advertisement or other promotional materials that promote Revenue Blue (Molten Infotech LLP)’s services without Revenue Blue (Molten Infotech LLP)’s prior approval.

9. Pop Ups/Under

Revenue Blue (Molten Infotech LLP) Campaigns can be distributed via Pop-up Window however the terms and conditions of the Revenue Blue (Molten Infotech LLP) campaign must be completely visible at all times. Multiple pops (more than 1) at the same time is not allowed. It is forbidden for a Revenue Blue (Molten Infotech LLP) network to generate traffic via distribution channels such by automatically opening windows, phishing, spamming or the use of spider and robot. It is also strictly forbidden to use Internet scripting, frames or programs to generate false clicks/leads/ sales on any Revenue Blue (Molten Infotech LLP) Campaign.

10. Branding

Network is not allowed to mention Revenue Blue (Molten Infotech LLP) in the title/body of adverts or to use the URL of Revenue Blue (Molten Infotech LLP), unless given written permission.

11. Advertisement Cropping

The landing page shall be completely visible at all times, i.e. without scrolling, I-framing or other comparable methods whereby the landing page or important elements (e.g. terms & conditions etc.) are not completely visible.

12. Mobile Push Ads

These are allowed but subject to prior approval. Network will need to disclose the Application that is used to push the notifications.

13. SMS Marketing

Networks are strongly advised not to utilize SMS Marketing to promote our campaigns, and any use of this is subject to prior approval. Unless a clear proof of ownership of the database and how it was acquired is provided to Revenue Blue (Molten Infotech LLP), SMS Marketing is strictly prohibited. Please discuss this matter with your respective Account Manager.

14. Whatsapp

Under no circumstance are networks allowed to advertise Revenue Blue (Molten Infotech LLP) campaigns via Whatsapp or similar messenger channels.

15. Telemarketing

Networks are forbidden from conducting telemarketing with end–users via information that might be obtained from Revenue Blue (Molten Infotech LLP) campaigns

16. Cyber Squatting

It is strictly prohibited to use a brand name or alterations in Web URLs that contain Revenue Blue (Molten Infotech LLP) Advertisements.

16. Payment for Commissions

Publisher found with multiple accounts without account manager or Revenue Blue (Molten Infotech LLP) employee written concern will be terminated with all the amount forfeited.

Payment for Commissions is dependent upon Clients providing such funds to Revenue Blue (Molten Infotech LLP), and therefore, you agree that Revenue Blue (Molten Infotech LLP) shall only be liable to you for Commissions to the extent that Revenue Blue (Molten Infotech LLP) has received such funds from the Clients and that such funds are sufficient to cover Commissions otherwise due and owing Affiliate . Any and all payments to Affiliate shall be made by Revenue Blue (Molten Infotech LLP) out of funds actually collected by us from Clients. You hereby release Revenue Blue (Molten Infotech LLP) from any claim for Commissions if Revenue Blue (Molten Infotech LLP) has not received such funds from the Clients
Revenue Blue (Molten Infotech LLP) may, but is not required to, monitor traffic for fraud. If fraud is detected, Affiliate’s account will be made inactive pending further investigation. If fraud is detected which materially affects and/or interferes with Revenue Blue (Molten Infotech LLP)’s business relationships, as determined solely by Revenue Blue (Molten Infotech LLP) , Affiliate will forfeit its entire Commissions, without regard as to whether such Commissions were earned as a result of such breach, and its account may be terminated. Otherwise, at Revenue Blue (Molten Infotech LLP)’s sole discretion, Affiliate will forfeit its Commissions, with regard as to whether such Commissions were earned as a result of such breach. In addition and expressly subject to the foregoing, in the event that Affiliate has already received payment for fraudulent activities, Revenue Blue (Molten Infotech LLP) reserves the right to seek credit or remedy from future earnings or to demand reimbursement from Affiliate. Expressly subject to any applicable third-party contractual restrictions, Aragon agrees to provide Affiliate with data supporting allegations of fraud, to the extent that such data is in Aragon’s possession and control. In the event of a material breach of this Agreement, Revenue Blue (Molten Infotech LLP) reserves the right to disclose your identity and contact information to appropriate law enforcement or regulatory authorities or any third party that has been directly damaged by your actions.

18. Middle East and North Africa Guidelines

The Network Partner will not promote services on sites (mobile or web) that are not suitable for viewing by general audience. The following are examples of the type of sites that are not suitable:

  • Gratuitous displays of violence and abuse of humans and animals which endorses or threatens physical harm.
  • Depictions of a sexual nature, pornography, pedophilia, obscene and vulgar language, or excessive swearing.
  • Any soft or hardcore sexual displays, including but not limited to naked or topless women or women in lingerie, or depictions of naked body from front or rear.
  • Any types of promotions and references of alcohol, smoking and drug misuse.
  • Any type of overtly political communication
  • Any types of religious content, imagery or symbols.
  • Any forms of illegal activities or their promotions (e.g. how to build a bomb, robbery, hacking, software piracy).
  • Any types of illegal substance or similar activities.
  • Illegal, false or deceptive investment advice and money-making opportunities.
The following political and cultural limitations also limit the types of sites that can be used for promoting our services. The sites used for promoting services must have:
  • No content with political sponsorship, political views and religious views.
  • No content proposing or alluding to betting or gambling.
  • No content referring, proposing or alluding to use drugs or alcohol.

Social Networking Campaign Guideline

  • Do not use misleading or made-up Ad Texts or Images involving actions by the user’s real friends (e.g. “Your friend has invited you too…”; “Your friend’s IQ score is…”).
  • Respect user’s privacy.

Incentivized Program Guideline

  • SMS services must not be associated with, or used to entice users to access content that is associated with any illegal practices such as copyright violations or piracy.
  • Applying the terms stated above in “General Guideline” especially no Cash-Back and Co-Registration unless prior approval by Revenue Blue (Molten Infotech LLP) .
  • The legitimate marketing incentive must be presented fairly and must not be misconstrued as being something other than what it is (e.g. a licensed movie trailer instead of a movie). It is not permitted to advertise a marketing incentive as free unless it is truly free to the customer. This should also be made clear to the customer signing up for the Short Code program.
  • Should SMS services be offered to customers in exchange for or in advance of getting to other content, such as in the case of legitimate marketing incentives, it should be clear to the consumer.
  • Content unlocking traffic is not allowed in Australia.

Revenue Blue (Molten Infotech LLP) Trade Mark Usage Guideline

  • Do not register any Revenue Blue (Molten Infotech LLP) brands without Revenue Blue’s expressed prior written consent. Revenue Blue (Molten Infotech LLP) will retain the exclusive right to apply for and obtain registrations for Revenue Blue (Molten Infotech LLP) brands throughout the world.
  • Do not use any service brand, service name, trade name, trademark, design or logo that is confusingly similar to (I) any Revenue Blue (Molten Infotech LLP) brand or any brand, word or design that incorporates the name of Revenue Blue (Molten Infotech LLP) or any of its affiliates, or any brand, word or design confusingly similar to any of the foregoing or (ii) any other service brand, service name, trade name, trademark, design or logo of Revenue Blue (Molten Infotech LLP) or any of its affiliates.
  • Revenue Blue (Molten Infotech LLP) will have the right to monitor all use of Revenue Blue (Molten Infotech LLP) brands. Samples of any materials bearing any Revenue Blue (Molten Infotech LLP) brands must be submitted to Revenue Blue (Molten Infotech LLP) upon request. Any use of Revenue Blue (Molten Infotech LLP) brands that is unsatisfactory must be immediately corrected.

Terms of Use

Revenue Blue (Molten Infotech LLP) is a licensed brand registered and trademarked by Revenue Blue (Molten Infotech LLP), these terms and conditions are designed to determine liability and can also be used as guidelines. Parties who agree on these terms and conditions are held by the rules stated in these terms and conditions. Any use of the intellectual property rights licensed by Revenue Blue (Molten Infotech LLP) - or any changes or adaptations to its intellectual property without Revenue Blue (Molten Infotech LLP)’s written consent - will be considered as material breach and therefore a violation of these terms and conditions and an infringement of the intellectual property rights of Revenue Blue (Molten Infotech LLP) , unless given expressed written permission by Revenue Blue (Molten Infotech LLP).
Revenue Blue (Molten Infotech LLP) may in its sole discretion at all times change the appearance or style of the advertisements within the network program, and networks will be informed in a timely manner if such changes take place.

Campaigns Removal

Networks must remove our campaigns at given timeframe from immediate to maximum of 48 hours (working days) upon receiving written notice from Revenue Blue (Molten Infotech LLP) . Urgency of campaign removal will depend on regulatory restrictions enforced by governing industrial bodies.

Representations

Network agrees not to use Advertisements or links thereto in a manner that disparages Revenue Blue (Molten Infotech LLP), or its trade names and/or trademarks, or portray Revenue Blue (Molten Infotech LLP) , or its products or services in a false light. Network agrees to promptly comply with requests of Revenue Blue (Molten Infotech LLP) as to the use of advertisements or its intellectual property rights and will not knowingly take any action that diminishes the value thereof.
Revenue Blue (Molten Infotech LLP) owns and/or controls and shall retain all right, title and interest in its names, logos, trademarks, service marks, trade dress, copyrights and proprietary technology, including, without limitation, those names, logos, trademarks, service marks, trade dress, copyrights and proprietary technology currently used or which may be developed and/or used by it in the future.

OTHER TERMS

Unless otherwise mutually agreed in writing by Publisher and Revenue Blue (Molten Infotech LLP) (which may include an exchange of emails), Revenue Blue (Molten Infotech LLP) will pay Publisher any commissions earned during a calendar month within 30 days after the end of the month (provided, however, that any account with a total balance less than $100 will be carried over and paid only when the balance exceeds $100). Revenue Blue (Molten Infotech LLP) is not required to pay Publisher if the Advertiser does not pay Revenue Blue (Molten Infotech LLP).
Delinquent Advertiser payments received by Revenue Blue (Molten Infotech LLP) will be credited to the Publisher in the month that they are received.
All commissions are based upon the number of Leads reported by Revenue Blue (Molten Infotech LLP) and as recorded in Revenue Blue (Molten Infotech LLP)'s systems. Publisher shall not earn commissions on Invalid Leads, as determined by Revenue Blue (Molten Infotech LLP) in its sole discretion.
Revenue Blue (Molten Infotech LLP) may also withhold payment to Publisher, offset against other payments owed Publisher or recover directly from Publisher in the event that Revenue Blue (Molten Infotech LLP) determines in its sole discretion that Publisher has engaged in unauthorized activity, including the generation of Invalid Leads, or breached its obligations under this Agreement.
In addition, if an Advertiser withholds payment to Revenue Blue (Molten Infotech LLP) or charges back previous payments because of actions of Publisher, Revenue Blue (Molten Infotech LLP) may also withhold payment to Publisher or offset such charge backs against other payments due Publisher (or if no other payments are due Publisher, Publisher shall remit payment to Revenue Blue (Molten Infotech LLP) upon demand by Revenue Blue (Molten Infotech LLP)) .
If Publisher’s account is inactive for a period of sixty consecutive days (meaning Publisher has not generated any Leads during such period), Publisher shall lose its right to continue to receive commissions from its referrals, if applicable, of other Publishers to Revenue Blue (Molten Infotech LLP).
If Publisher’s account is inactive for a period of six consecutive months, Publisher’s account shall be closed and Publisher shall forfeit any remaining balance in its account to compensate Revenue Blue (Molten Infotech LLP) for the administrative costs of maintaining and closing an inactive account.
If Revenue Blue (Molten Infotech LLP) determines, in its sole discretion, that the Affiliate or Sub-Affiliate has engaged in any activity that Revenue Blue (Molten Infotech LLP) considers to be fraudulent or which might bring the reputation or standing of Revenue Blue (Molten Infotech LLP) into disrepute either with the general public or with the Clients or potential Clients of Revenue Blue (Molten Infotech LLP), or otherwise that the Affiliate or Sub-Affiliate has engaged in activities which might be considered fraudulent, Revenue Blue (Molten Infotech LLP) may but will not be obligated to: (a) suspend or terminate the Affiliate’s membership in the Program, without notice; and (b) release to any third party, information relating to the identity and location of the Affiliate if required to do so in order to enforce these terms and conditions.
Any publishers found to be using proxy or any other type of fraud for any campaign, account will be suspended from RevenueBlue Network and all amounts will be forfeited.

Indemnity

Network shall defend, indemnify and hold Revenue Blue (Molten Infotech LLP) harmless against all claims, liabilities, losses, damages (including but not limited to direct, indirect, special and consequential damages), injuries and expenses including all reasonable legal fees claimed or incurred by Revenue Blue (Molten Infotech LLP) and/or third parties directly or indirectly as a result of any breach or alleged breach of these terms and conditions and/or terms of Use. Revenue Blue (Molten Infotech LLP) reserves the right to terminate any network relationship in the event of a breach of any of the guidelines stated and is under no obligation to pay any amount due to the breaching affiliate.
Revenue Blue (Molten Infotech LLP) reserves the right to amend these general terms and conditions and the guidelines from time to time, Network networks will be informed with a written notice if such an amendment takes place. The network is advised to regularly review the terms and condition as they are binding for all use of the network program. Should network not accept these terms and conditions, network must (I) immediately inform Revenue Blue (Molten Infotech LLP) hereof, (ii) immediately stop participation in the network program and (iii) remove all advertisements supplied by Revenue Blue (Molten Infotech LLP) within the network program.

Payments

  • All invoice payments must reach a minimum of USD 100.00 for payment to proceed from Revenue Blue (Molten Infotech LLP). Should the amount fall below the minimum, Revenue Blue (Molten Infotech LLP) has the right to accumulate invoices to meet the minimum.
  • Revenue Blue (Molten Infotech LLP) operates on a NET30 payment term across all Campaigns. Payment is made in the third week of the month.
  • All payments are done via NEFT/RTGS for India Affiliates and Via wire transfer, payoneer or Paypal for International Affiliates.
  • RevenueBlue will pay Service Tax only if you furnish a valid Tax Invoice in hard copy. All campaign payouts displayed in our reporting system are inclusive of service tax or any other tax.
  • TDS is deducted for Indian Affiliates @
    (a) 2% for companies with valid PAN card
    (b) 1% for Individuals with valid PAN card

Middle East and North Africa

This is an addition to the original Affiliate Guidelines of Revenue Blue (Molten Infotech LLP) which applies to all current and future campaigns.
In order for the Network Partner to be allowed to promote Revenue Blue (Molten Infotech LLP) campaigns in Middle East and North Africa countries, we will need the Network Partner to ensure that it, its affiliates, or any of its sub-affiliates is not promoting Revenue Blue (Molten Infotech LLP) Middle East and North Africa campaigns through placement of Reveneue Blues’s banners or other self-designed promotional materials (e.g. banners, pre-landers, text ads, etc.) on sites (mobile or web) that are not suitable for viewing by general audience.
The following guidelines cover all content formats such as (not only) graphical material, photos, animations, drawings, caricatures, screensavers, logos, text messages and video content in any format:

1. No Hardcore sexual material (included and not limited to):

  • It is not allowed to show male genitals
  • It is not allowed to show female genitals
  • It is not allowed to show sexual intercourse or act that suggest the same
  • It is not allowed to show masturbation and/or oral sex or act that suggest the same
  • It is not allowed to show sexual intercourse with animals (i.e. this includes petting or other sexual activities human + animal)
  • It is not allowed to show topless women
  • It is not allowed to show naked women (entire body or part)
  • It is not allowed to show women in transparent lingerie (panties or top)

2. No soft core sexual material (included and not limited to):

  • It is not allowed to show naked upper part of male body (upper half of the body naked) unless in a sporting context (i.e. swimming). The lower half should be covered by non-transparent clothing or otherwise)
  • It is not allowed to show naked body from behind
  • It is not allowed to show human trafficking in order to offer sex
  • Bikini is not allowed in any context
  • It is not allowed to show displaying of human excrements in relation with sexuality (for example showing of urine, stool, blood, etc.)

3. No depiction of extreme violence (included and not limited to):

  • It is not allowed to show torture and violence (against the will of shown persons) – this includes also all forms of practices that could result in an injury and serious damage to health.
  • It is not allowed to show satisfying oneself on dead human bodies (as well as their dishonoring), and genocide (racist motivated sexual, or other, humiliation of shown persons)
  • It is not allowed to show weapons, drugs, alcohol, murder, rape, hostage situations and criminal offenses.

4. Political & Cultural limitations (included and not limited to):

  • No content with political sponsorship allowed, political views, religious views e.g. Palestine, US related, Iraq, etc.
  • No mentioning or showing any type of content regarding the presidents, Kings and Princes of the countries
  • No content proposing or alluding to betting and gambling
  • No content referring, proposing or alluring to drugs or alcohol
  • No use of any offensive Arab related gimmicks such as camels, local Arab costume, insulting the Quran, etc.

Revenue Blue (Molten Infotech LLP) requires full compliance by the Network Partner to all the above stated content guidelines. Should there be any breach on these guidelines by the Network Partner, any of its affiliates or any of its sub-affiliates, we reserve the right to impose the Network Partner a penalty fine which will be calculated upon the penalty fine imposed by the gateway, operator or regulator.
